Dr. Richard Schmidt is founding and managing partner of SMARTLEGAL Schmidt & Partners.

Richard focuses on commercial arbitration and litigation in international and domestic matters.

He acts as counsel and arbitrator in ad hoc and institutional arbitrations, including under the ICC, UNCTIRAL, HKIAC rules and in front of the Hungarian Commercial Arbitration Court.

Richard has acted in complex legal disputes relating to among others, infrastructure, construction & engineering, real estate, M&A, shareholders’ agreements, finance, fin-tech, intellectual property, outsourcing, sale of goods, e-commerce.

Richard is enrolled as arbitrator at the Hungarian Commercial Arbitration Court and he is listed by the Vienna International Arbitration Court as arbitrator.

Besides dispute resolution, based on his significant expertise in construction & reals estate law, he regularly drafts and negotiates major industrial engineering contracts and advises clients on complex, high-volume construction projects, involving construction trusteeship.

Richard is Member of the Board of the Hungarian Arbitration Association (HAA) and of International Law Firms (ILF) a worldwide network of more than 70 independent law firms.

Richard is graduated from the Faculty of Law of Pázmány Péter Catholic University (Budapest, Hungary), acquired his LL.M degree in Belgium.

Believing that legal theory and practice are indivisible, besides supporting his Alma mater as guest university lecturer, Richard is author or co-author of several articles and books on international arbitration and litigation.

    Richard successfully represented our Italian Client from the oil & gas sector. The complex dispute regarding a Hungarian industrial plant was settled by arbitration in front of the International Court of Arbitration of the International Chamber of Commerce with the victory of our client.

    Richard represented a Russian manufacturer against a non-paying Hungarian company. The debtor, placed under legal pressure, finally paid the debt, so the Client could avoid arbitration.

    Richard represented a UK client in a commercial dispute involving the unlawful termination of a long-term lease agreement, and finally won the case in front a Supreme Court. The case was critical for the Client’s business in Hungary.

    Breach of exclusive forwarding contract

    Richard started arbitration on behalf of our client, whose exclusive forwarding contract was breached by the partner. The arbitration was successfully closed with a judgment in favour of our client.

    Breach of loan agreement, collateral alienation

    Richard won the case in court for our Swiss Client, offering lending and asset management services against a Hungarian debtor who failed to pay back the loan and alienated the real estate being the security of the loan. Richard reached a final judgement in favour of the client within 1 year.

  • Representing Greek Landlord Against Hungarian Tenant

    Legal dispute from a lease agreement

    Richard represented our Greek Client against its Hungarian tenant. The tenant accumulated a significant debt during the recent years which he paid back within 6 months after Richard started legal procedures.

    Richard represented a Romanian Client in an unlawful long-term contract termination case. Instead starting a never-ending court battle, he managed to settle the dispute with success through out-of-court negotiations.

Peter joined the firm in 2018 and passed the bar exam in 2022. Peter is now involved in more complex legal cases and coordinates several projects. His main areas are labour law and international trade and he represented Clients with success in front of Hungarian courts and authorities in many other areas as well.

In addition to his law degree, Peter is a certified Data Protection Officer and has legal English language qualification.

In addition to legal counselling, he frequently contributes to the SMARTLEGAL Newsletter with his great writings.

Peter joined the firm in 2019 and passed the bar exam in 2023. He mainly focuses on commercial & corporate law, and on litigations.

Péter has often assisted foreign companies in entering the Hungarian market, including corporate law and drafting various commercial contracts.

Péter also represents clients in litigation, non-litigation procedures and other official proceedings.

He is author and co-author of many articles written on litigation, published on Lexology and CEE Legal Matters.

As a trainee lawyer, she participates mainly by assisting the others in the preparation of the cases and in the development of legal summaries written about issues raised by clients.

She is mostly involved in labour law matters, but she also advises clients in the field of commercial & corporate law or represent clients in front of courts.

Agnes regularly writes articles in SMARTLEGAL Newsletters, mainly in connection with labour law topics.

Agnes, like many members of the firm, has been playing the piano since childhood, and she prefers to travel in her free time.
